1. Agreement to Terms

By accessing the Fleet Forrest website at fleetforrest.co.za, or by subscribing to or using any Fleet Forrest service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our website or services.

These Terms of Use constitute a legally binding agreement between you (“the User”) and Fleet Forrest (Pty) Ltd (“Fleet Forrest”, “we”, “us”), a company registered in South Africa.

2. Service Description

Fleet Forrest provides the following services, subject to an active subscription and a signed service agreement:

  • GPS Vehicle Tracking: Real-time and historical location data transmitted from hardware units installed in your vehicles.
  • Fleet Management: A centralised software platform for monitoring vehicles, managing drivers, scheduling maintenance, and generating operational reports.
  • Driver Behaviour Monitoring: Telematics-based analysis of driver events including speeding, harsh braking, and idle time.
  • 24/7 Monitoring & Recovery: Round-the-clock monitoring and stolen vehicle recovery support as included in qualifying plans.
  • Geofencing & Alerts: Configurable virtual boundaries with real-time breach notifications.

The specific features available to you depend on your subscribed service plan. Fleet Forrest reserves the right to modify, update, or discontinue features with reasonable notice.

3. User Obligations

By using Fleet Forrest services, you agree to:

  • Provide accurate and complete information when registering for our services;
  • Maintain the security of your account credentials and notify us immediately if you suspect unauthorised access;
  • Ensure that all vehicle operators and drivers whose data is processed through our platform have been informed and have consented where required by POPIA;
  • Use the services only for lawful purposes and in accordance with all applicable South African legislation;
  • Pay subscription fees on time as agreed in your service agreement;
  • Not attempt to reverse-engineer, tamper with, or interfere with any Fleet Forrest hardware or software.

4. Prohibited Uses

You may not use Fleet Forrest services to:

  • Track any vehicle or individual without their knowledge and consent, in violation of applicable privacy laws;
  • Stalk, harass, or surveil any person unlawfully;
  • Facilitate any criminal activity, including but not limited to vehicle theft, fraud, or money laundering;
  • Attempt to gain unauthorised access to other users' accounts or data;
  • Sell, resell, or sublicence our services without prior written authorisation from Fleet Forrest;
  • Introduce any malware, viruses, or harmful code into our systems.

Fleet Forrest reserves the right to immediately suspend or terminate any account found to be in violation of these prohibitions, and to report such activity to the relevant authorities.

5. Remote Engine Cut-Off — Governance & Safety

⚠️ Safety-Critical — Authorised Use Only

Remote engine cut-off is a safety-critical feature that must only be activated by authorised Fleet Forrest personnel or designated account administrators in accordance with strict operational protocols.

The remote engine immobilisation function is governed by the following rules:

  • It may only be activated in confirmed theft scenarios or under explicit legal authority;
  • The system is designed to engage only when the vehicle is safely stationary, preventing in-motion cut-offs that could cause accidents;
  • All immobilisation commands are logged with a full audit trail including the authorising user and timestamp;
  • Fleet Forrest accepts no liability for damages arising from unauthorised or negligent activation of this feature by the client;
  • Clients who misuse this feature will face immediate suspension and potential legal liability.

6. Limitation of Liability

To the maximum extent permitted by South African law, Fleet Forrest shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, including but not limited to:

  • Loss of or damage to a vehicle that was not recovered despite active tracking;
  • Data inaccuracies resulting from GPS signal disruption, network outages, or hardware failure;
  • Any business losses resulting from temporary service unavailability;
  • Actions taken by third parties (including law enforcement) in response to data we share lawfully.

Our total aggregate liability to you shall not exceed the total subscription fees paid by you in the 12 months preceding the event giving rise to the claim. Nothing in these terms limits our liability for fraud, gross negligence, or wilful misconduct.

7. Governing Law

These Terms of Use are governed by and shall be construed in accordance with the laws of the Republic of South Africa. Any disputes arising from or related to these terms or our services shall be subject to the exclusive jurisdiction of the South African courts. The parties agree to attempt to resolve any dispute amicably before resorting to litigation.
